GENERAL APPLICATION INFORMATION
A brief explanation of the use and process
Abandonment Application - used when requesting abandonment of street right-of-way, easement or reversion to acreage - per Humboldt County Code - Chapter 16.28 - Reversion to Acreage and/or NRS 278.480 through 278.4965. Conditional Use Permit / Special Use Permit Application - used to request approval for conditional or special uses as listed in certain zoning districts - per Humboldt County Code Chapter 17.68 - Conditional Use Permits or under allowed uses in various zoning districts, per Winnemucca Municipal Code Chapter 17.124 - Special Use Permits. These applications are scheduled for public hearing before the RPC; certain requests require final approval from the governing body with a recommendation from the Planning Commission. Neighbors within 300 feet of the subject property lines are notified of the public hearing. A fee is required. Home-Based Business/Conditional Use Permit Application - Home-Based Business/Special Use Permit Application - used to request approval to operate a business from a residence. Most homes are located in residentially zoned districts and a business is a commercial use, which requires approval of a home-based business/conditional use permit (County) or a home-based business/special use permit (City) prior to obtaining a City or County business license - per Humboldt County Code Chapter 17.76 - Home Based Business/Conditional Use Permit and/or Winnemucca Municipal Code Chapter 17.112 - Home-Based Business Special Use Permits. Applications from residents of the City and County may be approved administratively, if they meet the ordinance criteria. Applicants not meeting the administrative aproval criteria are scheduled for a public hearing before the RPC; neighbors within 300 feet of the subject property are notified of the intent to do business and the application must be approved by the Regional Planning Commission before staff can sign off on a business license. A fee is required. Large Parcel Map Application - used to divide property into large lots of forty (40) acres or larger per NRS 278.471. Applications are scheduled for a Regional Planning Commission meeting and final approval must be requested from the County Commissioner's before the final map may be signed and recorded. A fee is required. **Back to the top** Master Plan Amendment Application - used to request a change in the master plan designation on property (not the same as zoning). Applications are handled much the same as a rezone. A public hearing is required and the final decision is made by the governing body. A fee is required. Medical/Health Hardship Variance Application - used to request placement of a second dwelling in order to care for family members on property within a zoning district allowing only one unit per lot. This application process requires the following: A letter from a doctor stating the need, a drawing of the property showing the proposed placement of the dwelling, approval from the State Health Department for an additional septic system and tentative approval from the building department for any applicable building permits that may be necessary. The variance is reviewed yearly (a letter from the doctor required) and if the circumstances or conditions of approval change, the second unit must be removed and the septic filled in. A fee is required. Parcel Map Application-City - used for dividing property located within the city limits into not more than 4 parcels or lots, per Winnemucca Municipal Code Chapter 16.24 - Parcel Maps and NRS 278.461 through 278.469. Public hearing notices are not required for this action and the Regional Planning Commission makes the final decision. A fee is required. Parcel Map Application-County - used for dividing property located in Humboldt County into not more than 4 parcels or lots - per Humboldt County Code - Chapter 16.16 - Minor Subdivision and NRS 278.461 through 278.469. The approval for this process is administrative - there is no public hearing scheduled. If the parcel application is a subsequent series of applications, an overview of the entire project is required; after the first application has been administratively approved; all subsequent applications will be scheduled on the next available Regional Planning Commission agenda. A fee is required. Rezone Application - used to request a change in the zoning designation on property. This process takes approximately 45-60 days to complete. Notice of the public hearing is published in the local newspaper at least 10 days before the hearing date and notices are sent out to all properties within 300 feet of the subject property. A public hearing is held by the Regional Planning Commission and their recommendation is sent on to the governing board for scheduling on the next agenda. The Humboldt County Commissioners or the Winnemucca City Council set the item for public hearing and the notice is published in the newspaper. At the scheduled meeting, if the County Commissioners or the City Council decision is to approve the request, the zone change becomes law after having been published twice. A fee is required. Site Plan Application - used to review and approve plans within the city limits for all new construction on one acre or larger size property, or any size property immediately adjacent to a residentially zoned property within the multiple-family district or any of the non-residence districts - per Winnemucca Municipal Code - Chapter 17.24 - Site Plan Review Provisions. This is a public hearing process - all properties within 300 feet of the subject property are notified. A final decision is made by the Regional Planning Commission. Currently, there is no site plan requirement for development in the County with the exception of parking requirements. A fee is required. Subdivision Application - used to divide property into planned lots - per Humboldt County Code Title 16 - Subdivisions and/or Winnemucca Municipal Code Title 16 - Subdivisions. Applications are reviewed by the Subdivision Review Committee and a recommendation given to the Planning Commission at a public hearing. Notices are mailed 10 days prior to the meeting to all neighbors within 300 feet of the subject property lines. The Planning Commission may place conditions on the approval and the applicant must begin construction within the specified time or request an extension or the request becomes void. A fee is required. Variance Application - used to request approval to modify zoning requirements and/or development standards, such as setback requirements, lot dimension, lot area, building height and parking requirements per Humboldt County Code Chapter 17.66 - Variances and Winnemucca Municipal Code Chapter 17.116 - Variances. The application is processed by the Planning Department, but the application is scheduled on the governing body's agenda. Notices are mailed out 10 days prior to the meeting to all properties within 300 feet of the subject property lines. A fee is required. |
